Common issues for landlords include eviction and damages to the property caused by the tenant or the tenant’s guests. Common issues for tenants include constructive eviction, roommate disputes, a landlord’s failure to return a security deposit, breach of the covenant for quiet enjoyment (unlawful entry by a landlord) and breach of the warranty of habitability (landlord’s failure to provide required lease items such as heat, hot water and mold-free living conditions).
