Landlord and Tenant Law consists of legal rules and court procedures that govern the relationship between a property renter and a landlord. It is a combination of real property and contract law. it recognizes the need for different legal rights and remedies between commercial and residential leases. The law recognizes the need to provide specific protections for residential renters that differ from commercial leaseholders. Common issues for landlords include eviction and damages to the property caused by the tenant or the tenant’s guests. Common issues for tenants include constructive eviction, roommate disputes, a landlord’s failure to return a security deposit, breach of the covenant for quiet enjoyment (unlawful entry by a landlord) and breach of the warranty of habitability (landlord’s failure to provide required lease items such as heat, hot water and mold-free living conditions).
