Hello,
Hopefully you can shed me a little light here. I filed chapter 7 and had a rental property that was part of the bankruptcy, the mortgage co. will not take it out of my name or foreclose & their reasoning is they dont want to be liable for taxes, insurance and upkeep on the property as far as city code violations, and that i am responsible for all taxes, etc except for the mortgage pym. and they will just put a lien on it. Can they still make me liable for the insurance and etc when this was part of my bankruptcy?
Thank you for your advice
Block the calls or take similar actions if it continues you can file a harassment charge but even that is slim
Dear Law Professor,
I admit I don't yet understand how to use this site or perhaps it is just my panic over losing two homes in one year. I am writing because I posted a question to a forum and I have not yet received a response. May I initiate a conversation with you? Will you or another legal professional respond to my earlier post? Thank you so much. I am grateful for your help. Concerned714

Approximately 5 years ago, I had a remaining mortgage of $15,000. My daughter wanted to buy a house and her boyfriend had a ton of bills in credit which they had to pay in full before they could purchase the home. I mortgaged my house for $65,000, $15,000 to pay off the original loan, I had $5,000 in credit which they had to pay off first, and then approx. $5000 in fees. I was Fed Ex a check for $41,000 which I signed, and turned over to my daughter. We had a fight in May ('08) and she has stopped paying her share of my mortgage. The mortgage is ONLY in my name. She pays $350 and I pay the difference. Do I have ANY legal recourse available to me to get my money back????

a friend of mine was facing foreclosure on her house in massachusetts so she let me stay here rent free until the forclosure took place. i am not paying any rent to her. the home auction is taking place on september 4, 2008. will i have any time after that date to move out
Have a dilemma on an old debt, Old Republic (a collection agency) is attempting to sue me for $17,000 by filing a judgment with our county courthouse (Harris County TX). I have been served the documents and have 20 days from Aug 22, 2008 to respond. The collection is from early 2004, a foreclosure with Countrywide Home Loans. My question is, my credit reports state that I was 180 days late in May, 2004; the last reported date was June, 2004 and they filed for judgment on August 18, 2008. I haven't made a payment since the foreclosure or from 180 days prior to May 2004. Can I use the Statute of Limitations defense in the state of Texas since it has been more than 4 years since date of last activity? Also, how can I be sure the date of last activity is accurate for the defense? Do they utilize credit reports as legal documents? Is it straight forward or should I retain an attorney?

HI, I have a question and I hope that you can be of some help. I'm being sued and in the documents it tells me that I need to go to the court house a file a written letter with the court clerk, this is what I don't understand, are they asking me to admitting of the suet against me or are they asking me to file a letter with the court clerk of making some arrangements with the law suet against me, could you assist me in this, I have never had this done, would like some help on this issue.

I have a question, I'm being sued from a credit card company, I have never had this done, but I guess life is what it is today, anyway, the question is, after recieving this letter from the courts of the law suet, it tells about something of going to the court house and writing a letter of some type and filing it with the court clerk, what type of letter are they asking about, would it be that of admitting it or does it mean to make some type of arrangements to this law suet, this is the part that I really don't understand, can you assist me.

I am wondering if I have a small claims court case:

I am a graduate student and share an office with two other students. On Friday, August 22, one of my office mates let her friend (who is not in our department) use our office to study while we were in a meeting. She never asked me for permission, nor did I say anything. While we were in the meeting, this friend left the office without closing the door. My laptop was stollen.

My insurance company will pay for most of it except a $1000 deductible. I have asked my office mate and her friend to help me with this cost, which does not even cover the lost software, data, and pictures. Both have told me they live paycheck to paycheck and cannot help me to pay the deductible.

Can I take them to small claims for the $1000 deductible and the software I need to replace which will be around $1300?

I did not ask this person to close the door if she left, so I am wondering if I am wrong? But when my office mate called her back, she did state that she thought she closed the door, but must not have. Also, my office mate told me her friend is trying to see if her home owner's insurance will help pay since she feels bad for not closing the door. By saying this, does it make it obvious that she knew she should have closed the door?

Hi, I was wondering if you could help me. I live in Florida and I am wondering if I file for child support will the judge give him visitation or is that another court date?
I went through a not so amicable divorce. Divorce was finalized in January 2004. The ex-husband wanted the house on 60 acres, but behind my back and filled bankruptcy. In the divorce decree, he was suppose to refinance the mortgage in order to get my name off the mortgage note. He waited for the 6 months to be up & then filled bankruptcy, he also quit making payments on the mortgage. The bank would not work with me or accept any payments from me. My ex husband also had moved his daughter & boyfriend in, & I had to get an eviction notice on them, even though my name was still on house. The foreclosure is presently on my credit report, is there any way to get it off my report? I have a copy of the dicorce and agreement stating such facts, however since it was over 3 acres the bank gave me 12 months before final foreclosure. Help?

Thanks Mark!!! Good to see you back. Hopefully you're doing well out there and miss having you around. Still will try to make this work and do the right thing, helping people around the globe. :)

Hopefully this message system will be used properly soon and people will ask questions in the forum instead of dumping them on profiles! Will have to work on that one next, lol!

I co-signed on a lease for my son. He shared this apt with 4 other college students. Their parents also co-signed on the lease. Towards the end of the lease noone payed their share of the rent. And to make matters worse, their were damages to the apt. The bill has gone into collections and totals $4415.00. I am more than willing to pay since I dont want this on my credit report. However, I was told the only way to avoid further collection is to pay in full. It doenst matter if I pay monthly. They will still proceed with collection. Am I responsible for the other co-signers debt? What are my options.

I signed a contract with a dealership to buy a 2004 SUV. I have had the car for 1 week now and the dealership call me and say there was a mistake witht the contract you signed, you need to return the vehicle now. They said I can keep the car if I have a cosigner...shouldn't they have told me this before the loan even went through? Help me please.
