Wrongful Termination?

I was terminated last Thursday. I was never written up or warned that my job was in jeopardy. I was out sick for a week, with a doctor's note. I had a pre-approved 3 day leave of absence after that to have a procedure done. When I returned to work I was told that I violated the attendance policy and was terminated. This was done after I had worked almost the entire day. I just want to know if I have any type of case. I am an RN, and will find another job. But would like some compensation from them until I am able to find something else if possible.

An employer isn't required to warn you before firing you any more than the police are required to warn you before you are arrested.

An employer doesn't need a reason to fire you, any more than that same employer require a reason to hire you, other than an employer can!

As far as the employer paying you after you are fired, think about that for a second.

If firing someone is cause to pay them, no one would ever be fired.

What do most fired employees receive after being terminated? UNEMPLOYMENT COMPENSATION.

Apply for UI if you wish. The state will determine if you qualify.

You're an RN, so move on, seek new employment.

Based solely on the information in your post, this is not a wrongful termination as defined by law. If you have additional facts that you believe would change the answer, please feel free to post them.

Might you & your employer had met the requirements for job protected FMLA leave? Here is a link to the requirements:
http://www.dol.gov/whd/regs/compliance/whdfs28.pdf

If not, you might want to read these two links for educational/informational purposes re at-will employment & wrongful termination.

Based just on what you posted without additional details, I don't see a wrongful termination. File for unemployment ins. (the state will decide if you qualify) & look for other employment which it seems you are planning on doing.
