Mom was sent a Notice to Appear and a Petition for Visitation from dad via certified mail as per the court. She called dad to see what it was about and he explained he was taking her for visitation. She now is not picking up the notice from the post office and not returning phone calls. What will happen if she does not pick up the notice and therefore does not show up in court?

If this is the first court date regarding the matter, Mom will probably get another chance - the hearing will likely be postponed.

But if it happens again or keeps on happening, Dad will generally get what he's asking for.

It's NEVER in EITHER parent's best interest to ignore court dates.

Mom could eventually be held in contempt of court.

She could be summarily fined by the court, effectively taking food out if her childrens' mouths.

Mom could be summarily confined in some filthy hoosegow, effectively giving dad her babies.

Mom shouldn't mimic the ostrich by burying her head in the sand, because the lion will not be fooled by a game of peek-a-boo.

Every citizen would be wise to adhere to all court orders.

Ignoring a court is NOT BRIGHT. It won't go away just because you don't pick it up. When it is sent to your mail box you are assumed to have received it. Army is right, she may very well be held in contempt of court. GO! You have to.

Is Dad going Pro Se?

Did Dad actually follow the local rules of the court and have Mom properly served?

Does MOM have an attorney?
