Vacation

My wife was awarded her vacation early on June 19th thru the 23rd, she didn't request it and she wasn't supposed to get any paid vacation until August of this year. She has recently accepted a position at one of the competitors offices, when she put her 2 weeks notice in; they let her go. As she was leaving her boss told her that they would probably take out her vacation pay, (that she was awarded and paid for on June 30th) on her next check coming up on July 28th. Can they do this? Keep in mind, my wife didn't ask for her vacation to be paid, they just did it.
 
I have to agree that if she hadnt' truly earned it until August and they gave it to her early (confused whether that was her choice or theirs to give her those dates off and then to pay them early), then you would need to go back to company policy and generally in most states they can clawback negatively used PTO.
 
You never know, when the Big Boss cools down, she may decide to let it go.
