probation officer abusing resources

    Can an off duty probation officer run license plates on people for personal reasons?

    It depends, because anyone can use a number of databases to run license plates for many reasons, one of which is simply research.

    If the official state inquiry system is used, that would likely be in violation of agency policies and procedures, as well as state and federal law.

    If they use the official state inquiry system, can the history be looked up each time that person does a search?

    For PERSONAL reasons? As in, not work-related at all? Then, no. But, if ostensibly for some work reason, sure!

    And, yes, the inquiry is saved and can be looked up generally at both the local and the state level.

    Perhaps you'd care to add a few details/facts?

    Yes. Not work related. Anytime this PO sees the ex driving or riding in a vehicle, PO runs the license plates.

    PO has even contacted owners of vehicle to let them know that she knows the vehicle belongs to them.

    Okaaay ... that doesn't mean there was not a legitimate purpose. The PO might be running the names to identify who the probationer is associating with - there could be a good reason. We do that from time to time.

    But there is no probationer. She is doing this against her ex husband. Hence, personal reasons.

    Wouldn't you think She is taking advantage of her position and violating policies?

    I used to work as a CPS investigator so I'm assuming probation officers follow similar guidelines?

    Yes, that would be illegal! Whoever has firsthand knowledge of this activity should report her to her office, local law enforcement immediately, or the Texas Department of Public Safety as I believe they have responsibility for the statewide network that is used to access these networks).
