Hello all,
I am a mechanic for a trucking company in South Carolina. The general manager states that I am exempt from overtime pay because my job title is maintenance. I have checked federal, state, and DOT labor laws and I can not find anything that says this is correct. I found one thing on the federal law that states maintenance workers or mechanics are exempt from overtime if they work mainly in a sales area. I do pure physical labor for 50 to 60 hours a week. I have sent many printouts I found on line to HR, the general manager, and the owner of the company. HR said I should get overtime. The general manager said I couldn't get overtime because I was "maintenance." The owner said that as far as he knew his company was within the legal requirements. If I am wrong then I will just suck it up, but I don't feel that this is right.
Any help or information regarding this issue will be greatly appreciated.

You're likely to be proven right, but you'll probably end up on the outside looking in. You might also begin seeking new employment. These stories often end poorly for people that are wronged.

Thanks for that information Betty3! It looks like they can claimed exempted for me because changing lights and mud flaps "could" be considered safety concerns. I know they are DOT violations, but safety concerns is stretching the definition.

Thanks Army Judge. I'm more concerned for the legal operation of the company since my grandfather owns it. My uncle is the president and my mother is in charge of HR. I recently hurt my back at work and had to quit, so I'm already on the outside.
