Notice Required before Removing Employee from House??

This concerns a private sector employee who is hired to work & live in my grandmother's home (a home health care worker). There is no contract.

I wish to know, as the employer, what is my legal obligation before terminating this person's job. I understand there is no notice required before her job is terminated, but what about the removal of her from the house? Is notice required? The employee also has her husband staying in the house.

You can ask her to leave.

But, some people like you describe, eventually have to be evicted.

I suggest you bone up on evictions in VA.



After you ask the couple to leave and they refuse, I suggest you have the notice to quit letter on your person to give them. Then when they ignore that, get ready to file an eviction action, pay for it, have them served, and wait another 6-8 weeks before a judge eventually orders them gone!!!



Alternatively, you can retain an attorney to do this for you.

It won't be quicker or cheaper, but they will see you're serious, and it'll be done right. Sometimes they will leave if the notice to vacate letter comes from your attorney.
