Hello,

Recently I received some papers in the mail from the state where our divorce was filed. My ex managed to somehow go to court and get our divorce agreement changed without me being served or informed in any way. Which includes taking my spousal maintenance away.

I need to know how I can go about fixing this. I can't afford an attorney as I don't work because I am disabled and have been since 1999. So I have to do this myself. I have tried legal aide but haven't had any luck with that. And I have been unable to find an attorney that will help me.

I also can't afford to go to the state where the divorce was filed, and was going to see about getting the agreement changed to the state where I live with our son.

Mist likely, your "ex" spouse obtained whatever decision against you by default judgment.

As it was in a state where you don't reside, you might have missed being notified, or he served you by publication.

You can't get this changed by bringing an action in your state.

You might be able to attack the decision in the state where it was rendered.

That could be a very difficult task.

As you have limited funds, and no one wants to help you, you might be stuck with the decision as it is.

If your ex still lives in the state where you divorced, they retain jurisdiction. When you move out of state you have to deal with the inconvenience of the other state retaining jurisdiciton. You do not have many options but to argue that you were improperly served but an attorney in the state where you divorced needs to help you. Unfortunately you being out of state is going to make this difficult.

What was the basis of the modification of the decree? In the original decree was there a stipulation allowing for future modification? If so...What does that portion of the stip state WORD for WORD (sans identifying information).
