What if a half time position is doing exempt level work? The formula for exempt salary is equivalent to no less than two times the state minimum wage for a full-time salary. can you still be exempt at half-time. That is full-time for 2016 is 2 x $10/hr (the new min.) x 2080 hours = $41,600. So would it be half that for 20 hours per week? Or 2 x $10/hr x 1040 hours = $20,800?

Each employer determines what an employee is paid for doing a particular job.

That is also true when the employer classifies one position as exempt, the other non-exempt.

If you believe you're being paid too little, classified improperly, your remedy is to seek employment elsewhere.

Employees don't determine how much they're paid, under which classification they're employed, or anything your post supposes.
 
It doesn't matter if the employee is full time or half time. They have to meet the minimum exempt level salary or they cannot be considered exempt no matter what level work they are doing. If that means they have to be paid $41,600 for 20 hours a week, then that's what it means.
 
Agree with cbg. If you are salaried exempt, you do not get paid by the # of hrs. you work but a fixed weekly salary. You must be paid the min. weekly salary required for salaried exempt.
