I am needing to find out how I can get help on getting joint custody of my son who right at the moment is with his mother. She is threatening to leave New Mexico with him and is refusing to let me see him. How do I go about fighting for joint custody and to keep her from leaving New Mexico? I am also not able right now to afford an attorney at this time, I was told I make too much to get a legal aide attorney. Please e-mail me back. Thank you

Has paternity been established? Did you sign the birth paperwork? If you did, then you probably just need to go down to the courthouse and file for custody. If you are not om the birth paperwork, you need to legally establish paternity first.

Has paternity been LEGALLY established? Is there a current custody order?

I'm not sure about New Mexico's Laws, but you should be able to file a motion to keep your child in the same state and even limit her where she could move your child. You can file the motion and represent yourself saving alot of money. There should be a link on-line to get the appropriate forms.
