Hello. my exwife was awarded the marital home through divorce. Already finalized last year. She was given until May 2025 to get her own mortgage and pay off the current one in my name alone. Well I now filed bankruptcy not knowing she was behind on payments so they are going to kick her out. Can she sue me for "breaching" the divorce agreement?

see picture for paragraphs about the house in our agreement.

Any human being has the ability to bring a lawsuit against any other human being.

That said, no human being is capable of predicting the actions of other human beings.

I doubt that your divorce decree spoke to issue of you filing bankruptcy. You are certainly free to file a bankruptcy, the trustee allowed it, and a federal bankruptcy court judge seemingly discharged your debts.

Based solely upon your brief recitation of events, I rather doubt that your former spouse would be successful in suing you for breaching some agreement.

Finally, if this still worries you, you can consult with a couple attorneys in the county where you reside.
