I used my sick days for maternity leave. I had built up 42 days. I have a pre-existing blood clotting issue for which I filled out disability forms prior to my labor and delivery in case I had complications during the birth. I did not have any of these issues so the disability claim was not necessary.
When I began having some mental issues post pardum I requested to extend my maternity leave using FMLA time. I am being denied FMLA time because my employer stated I have already used the 12 week FMLA leave (even though my child is not yet 11 weeks old). I have never filled out any FMLA forms.
What are my rights? Have I used FMLA time? Can it coincide with my sick time in which I was paid my full salary even though I never filled out anything stating I wanted to use FMLA?
This is my tenth year as a teacher in the school. When I first asked for FMLA I was told I was not fit to return and they wanted to buy me out of my contract. There were going to give me $1900 in disability pay in this package....I am very confused about what might rights are, and what time I have used to this point- was it sick time, disability time, or FMLA?
