My brother is the father of a 19 month old son. The parents are not married, have shared custody, but the mother has residential custody of their son. My brother works full-time and has regular visitation. He was offered free daycare services by his employment, the YMCA. The mother has told him no that he must pay for daycare near her because she does not want to drive the 20 miles round trip to the YMCA.
Also, the custody agreement states he have alternate weekend and weekday care of his son. The mother is stating that he will not be able to see his son during the week and must pay for the daycare of her choice solely.
Are there any options for the father? Can he insist on the daycare choice?

This can be resolved by the court.

He can Petition the court for redress of his grievances.

They'll live the much of the next 18 years in court resolving these disputes.

Okay. He will be filing for full custody soon. If he must resolve this daycare issue in court, is it possible to request to be fully reimbursed by the mother, since he has access to free certified daycare at his work place?

If he has access to free child care then that is a good defense to not be ordered to pay it. If mom wants to use her daycare then she should pay, plain and simple. Also she must obey any custody order and on his time he does not have to use mom's daycare. i would stop listening to her and take mom to court. If mom is in contempt and is not going to give Dad his parenting time the she can pay for her own daycare while she is committing contempt. Mom needs to be careful here. NY is a really bad state to pull this crap as they are one of the few states that have a law against parental alienation. Dad has been awarded joint, mom faces alot of problems in famjily court if she disobeys orders.

I have mentioned this to my brother and we are looking into this. Thank you.
