My daughters father and I have Joint physical custody, although he has her for 1 full more day than I do..since you cant split 7 days evenly..When my daughter arrived at my house the other day I found out that her is moving at the end of this week, he has not told me about this. He did this once before and told me when he was all moved in that he moved 15 minutes away. This will be his 3rd move in a year and a half, he has a history of eviction. I was told that 6 people will be sharing a 3 bedroom apartment, 3kids and 3 adults. I dont know where he is moving since my daughter has no clue either, not that it is her job to inform me. Me and her father used to live an hour and a half away from the area where we both currenly live. I am scared that one day he will move back there and not tell me til he does and then what? I wont be able to see my daughter as much because what happens with her school? Is there anything I can do about this? I have tried to contact him but he never answers my calls or texts

Petition the court and request a hearing on the move.

Your custody order provides you both with what you can do.

It limits the distance you can move.

Contact your lawyer, or hire one, and request the matter to be heard.

You are right to be concerned about schooling and the alleged living conditions.

He is most likely required to inform the court when he moves, if not, ask the court for that to be in an order, as well as the living arrangements.

There is a reason you aren't married (or never were), so in most cases it keeps it civil when these issues are litigated before the court.

It does make the entire process more costly, and lengthens the decision and notification process significantly.

One day this too shall pass.

Do you have Joint LEGAL custody (Decision Making) for your child? If you do, and your child's school will be changed due to the move, this would be a valid motion to COC.

Dad's instability would also be a valid reason to motion for a COC.

The alleged living situation may, or may not, be a valid reason to bring a motion.
