Can my ex-spouse claim arears in child support after the child has turned 18 and graduated high school, no child support enforcement was ever required or contacted prior, the ex-spouse is remarried, and there is no proof of payment or nonpayment (ie receipts) of child support.

If there is court-ordered support and the support wasn't paid (the burden of proof would be on the NCP, incidentally, to prove that s/he had paid) then the CP can absolutely enforce arrears. However s/he only has 10 years in which to do so.

If there was no court ordered support, there can be no arrears!

We never went to court. She had an attorney draw up the divorce papers in 2005 and in 2006 he filed them. The child support was included in the papers. Would this be considered court ordered?

What did your final decree contain?

You need not answer me.

You need to know.

Get a copy and review it.

I'm guessing the support was never court ordered.

If it wasn't, you aren't legally obligated or obliged to pay.

Get your decree and educate yourself, man, it is your money; isn't it???
