I separated from my husband 5 months ago. I had leased a 2105 car solely in my name, at the same time we bought a 2015 Prius. We both signed the loan papers with Toyota. I am the original signer and he is co-signer. He is still driving the car, while I am still making all the payments on the car and still paying insurance for both cars. Can I go take the car he is driving back. When my lease is up in 14 months, I want to driver the car that I am paying all the payments on. He does not have much income and cannot afford to take over the payments nor refinance. Both of us are retired, however I had to go back to work just to keep making the payment and be able to pay for my rent.

The car is as much yours, as it is his.
LEGALLY, taking the car SHOULDN'T land in trouble with the authorities.
However, don't trespass to take the car, as that could land you in hot water.
If you observed the car parked on a public property, taking it wouldn't run afoul of the law.

Bear in mind if you do that, he could be motivated to snatch it back from you.

The car is as much his, as it is yours.

I suggest you file for divorce if you wish to cut all ties to a deadbeat.

Otherwise, you and he could end up playing "snatch the car tag" for months!
