annulment?

a friend of mine married her boyfriend right after he was charged an incarcerated with murder. Its only been roughly 6 months an as shes learned more about the case has since left him, however is still married to him. She wants to get this taking care of.....is there any grounds for an annulment? or is she stuck getting a regular divorce?

Annulment or divorce, little difference.


Seven grounds for divorce in New York State:


One spouse convicted of a felony

Abandonment two ways:
Absence for a period of more than five years
Constructive abandonment (refusal to have sex for a period of more than one year)

Adultery

Cruel treatment

Disappearing for 3 years

Living apart for one year pursuant to a separation agreement or separation judgment

Irretrievable breakdown of the relationship for a period of at least six months





Annulment

ANNULMENT is a legal process in which a court essentially determines the parties were never legally married to begin with and the marriage is null and void. Annulments are not often granted, but grounds for doing so include if one party is incapable of consent, due to mental state or INTOXICATION, FRAUD about some aspect of the marriage, or a failure to CONSUMMATE the marriage. Annulments are regulated by state law.
