Need Child visitation information for arizona

I am in the process of filing for a divorce from my wife. we have a 3 year old son, and currently she will only let me come to the house to see hime for short periods of times a couple times a week. Every time i do this, there is either people at the house, or she has someone come over once i get there. These people end my ability for vissitation because my son wants to visit with them instead (grand parents, aunts, uncles..)

Do i have the legal right at this time to take him out of the house for my visitations?

Since you are married you have qual rights to mom. She has no right to dictae anything. I am in AZ. Are you in Maricopa County? Document everything. Mom is going to have o explain and have a good reason to withhold visitation. You can see an attorney or file for mediation through conciliation services.
 
i am in maricopa county. Thank you for the info, i just spoke to a lawyer about the situation, and he advised me to send an e-mail stating that i had as much rights as she did, and to request visitation time, and keep it all documented for later.

Unless and until there is a court order, your rights are equal to the mother's. You have as much right as the mother does to keep the child in your home.

In other words, you can force the mother to visit the child in your home. That is probably why the mother is chicken hawking the child. You have the right to take the child to reside in your home.

what are the circumstances behind your not being in the house?

do you have your own place? or are you living with another woman?

did you walk out on your family?

leave bills unpaid?

do you show up each and every time you have time with said child? or do you bail on him? give up trying to see him?

have you filed for divorce yet? why or why not? spending too much money on "other" things?

you see all of these things need to be taken into account because many times it's not just as cut and dry as "she won't let me see my child"
