A week ago I accidentally put my car in a ditch (I have night blindness). My boyfriend went outside and tried getting it out of our ditch. Well during this time I downed a few shots of vodka. I was not drinking when I was driving or before that. I only started after I got pissed off. Well the cop who arrested my boyfriend came up to talk to me. He asked if I had wrecked the car and I admitted it. Then he proceeded to give me a field sobriety test. By that point an hour had passed and I was unable to pass it. He then asked me if I had been drinking. I thought he was talking about when I was driving the car and replied no. What are my chances of being found not guilty of the DUI?

A very creative attempt, but its been used before without success.
In order to defeat the DUI, you'd have to prove that you only drank after the accident.
But, you need to speak with a lawyer.
There are other ways to legally beat a DUI charge.
It isn't wise to admit to anything or plead to anything without benefit of counsel.
There are severe penalties and restrictions that come with a DUI conviction!

So, this happened outside your home? And he happened to bring out a bottle of vodka and a shot glass? Not the usual response to a collision, but, okay.

Okay ... why was your boyfriend arrested? Wasn't he simply trying to get the car out of the ditch from near your house?

Not knowing what the prosecutor knows we cannot venture a guess. You need to consult a local attorney that specializes in DUI defense to best hedge your bets.

Your tall tale (which most any cop, prosecutor and judge are going to believe is BS) MIGHT work because it offers up reasonable doubt as to your inebriation at the time fo the collision. But, depending on your BAC you might have had to consume a LOT of booze in an hour to get there so quickly and that may ultimately be your undoing.
