    your best bet is to have the problem fixed and deduct that amount from the rent. your landlord will have a difficult time evicting you since these were repairs he should have made. verbal agreements are just as legally binding as written ones.

    Sole-proprietor businesses have their assets and liabilities tied together with the individual, so I would say the loan is not exempt from chp 7. If the person has a separate account for the business, however, you can discover whether there are any assets in that account during proceedings.

    How large is the debt? If large, consult with a bankruptcy attorney. They understand things like statutes of limitations on debts and default judgments and voiding judgments. If the debt is small, pay it. About the fraud...where did you get the information that you are being charged with...

    The landlord is responsible. Small claims can handle these kinds of cases, assuming the cost of damages is not too great. Insurance can be useful in situations that your landlord has no control over. It is not intended to cover her risks.
