So I found out that once my son's father is convicted of his crimes that I can petition for his parental rights to be taken away without his consent. So my question is in jail he was served with child support papers once I get his parental rights taken away. Will he still be obligated to pay? I heard once he goes up-state he can earn a "minimum" wage and that will go towards all the support he owes. He is facing lots of time behind bars is it even worth my time to get his rights taken away? My son is 4 and he will be over 18 before his father is even considered for parole. :confused:
 
You can petition the court to have his rights terminated, but if you are not remarried and do not have a husband willing to adopt, it might not be granted.

If you terminate his rights, he will not be paying child support.

I would not want anything from him if I were you. If you file for CS you probably won't any while he is in jail, they make much less than minimum wage and if he pays for the child,m he will want to see the child.
