My husband recently worked for a very small construction company. He quit after three weeks. The second week he worked there the owner decieded to buy tools for him with out asking him first. He then told my husband that he would just take it out of his pay. My husband did not argue with him about it because the guy has a hot temper. They took the amount of the tools out of his last pay check. Hy husband never signed anything allowing them to do this. We dont want the tools, we just wanted to give them back and get the money. The tools are currently in our posession and the ex-employer is saying that because my husband did not argue with him that is was a verbal contract. I have read on the NC Labor Laws website that he can not take any money out with out a signed agreement stating that before the transaction occurs. Is there any way to make him give us the money back for them in exchange for giving him back his tools.
