Unless there is allegation of some other abuse or neglect, merely sharing a bed with a parent is not going to be sufficient to lawfully take a child into protective custody.

It might not be the best arrangement particularly if the child is the opposite sex of the parent but it isn't illegal as long as nothing else is going on that would make CPS concerned for the child.
