:confused:Must I file a claim to sue a person in the same city on which it accured?The defendant and I both live in the same state but I live 400 miles away from where the defendant lives and were the injury accured.

California usually requires you to file your claim in the court where the defendant lives or does business.

There are a few RARE exceptions.

Those exceptions are for contracts, corporations, and automobiles.

Your case isn't of that variety.

You appear ready to pursue a personal injury claim.

That means you have to file in the county where the defendant resides.

The website will talk you through the specific requirements for filing your lawsuit.

If my memory serves me correctly, it'll cost you between $30-100 just to file your case.

Then you'll have to pay to have the defendant served.

The fees vary for service, depending on how you want them served.

I'd advise you pay the sheriff (or law enforcement) to serve your defendant.
