Want to get a divorce from my husband. Just found out after 4 years of marriage that the house he claimed was his is not in his name. I sold my home and invested almost all the money in remodeling this house. Now I find that he signed over the deed to his brother who lives in Germany so that he if got sued he wouldn't lose the house. Do I have any claim against the house? Do I have any way of being able to recoup any of my money? He tells me "Sue me, good luck!" There is no money left in our savings, nothing for me to able to live on when I leave him. Can anyone tell me if I can fight this some how or have I lost everything?

The real problem is you have no money to pursue a claim. You could sue him for fraud and his brother for unjust enrichment, fraud, and quantum meruit but you don't have the money to pay an attorney.

Did he assign the deed to his brother via quitclaim? This I do not know yet, I found on the online County Website that the house was in his brothers name, I haven't gone yet to see the county records, which I plan to do.

Why did you sell your home? We decided to live in his house because it was larger than my condo, but it needed to be updated.
How much did you contribute to the repairs? I've been going through the receipts and trying to remember all that he's done even without receipts, it comes to about a $100,000.
What inducements were used on you
to repair the home? That he would put my name on the deed and that I would own the home with him.
Who was your money given to for the repairs? Various contractors, we've had different things done in the last 4 years. The house is old and needed so many upgrades.
Do you have receipts for the repairs? Yes for most and all the new appliances we had to buy.

California is a community property state.

In community property states, everything you acquire is jointly owned.
Your name doesn't have to be on anything to exert ownership and control over it.
Your marriage license does that for you.
Things you owned before the marriage are treated separately.
Things acquired in the marriage are jointly owned.
You need to know exactly when he deded the home to his brother.
I hope it was after the marriage.
But, even if it wasn't, you are entitled to the appreciation of the home due to the seed money for the repairs.
Living in California, if you sue him FIRST for divorce (or cross claim), you can sue him for your lawyer's bills.

You can also bring fraud charges on him for inducing you to put money into a home he surreptitiously deeded to his brother, but lied to you about.
Beg or borrow some seed money to use as a retainer to hire a good divorce lawyer.
