my employer and I have a agreement that he would pay me 10.00 for 80 hour and the rest in cash. But my time cards have been coming up with 144 hours every two weeks and he has been paying me for 90 hours regular hours and no cash so I know if I take him to a attorney and or small claims I will be paying for un paid taxes but will I come out with money or should I just walk away knowing he is a thief this has been the last year or so. I have all my times documented at home I wrote down everytime I clocked in and out so I have the proof and he is supposed to be keeping our time cards I believe.

The courts will not enforce an illegal agreement.

You'd be implicating yourself in a potential criminal conspiracy by pursuing this before the courts.

You'd also be implicating yourself in a criminal enterprise to avoid paying taxes.

I suggest you seek new employment and agree to be paid above the table, not under it!

You're also cheating yourself out of potential social security benefits one day.

You're also cheating your state tax authorities.
