UIB denied due to severance pay

appealing the denial of UIB due to receiving severance/vacation pay until. The check says pay period from 6-26 to 6-29 not the dates listed on the UB-098-J which are 6-28-09 to 7-15-09 for vacation and 6-28-09 to 10-3-09 for severance. How do i win this appeal? My former employer never said this check should last you until October she said here is a little severence for your time with us.. Now she is fighting it.. Please advise

What makes you think the employer is fighting it? (And if she is, where did she say that she wouldn't fight your receiving unemployment at the same time for which you are receiving severance?)

The fact is, most if not all states have regulations regarding when you can receive unemployment and severance at the same time, and when you can't. For example, in my state you cannot receive unemployment for the period that your severance covers UNLESS you had to sign a waiver to get the severance. However, once the severance period expires, you become eligible for UI.

What did your state UI office say was the reason for the denial?
