I'm working for a company "nightclub" that takes 80% of our tips and labels them as a "Service Charge". The other 20% they consider as our tips, which we are rightfully taxed to comply with the IRS. They use these "Service Charges" to pay off our commissions that we make each week from our sales. Is it illegal for a company to take a majority of our tips, label them as service charges, and then pay our commissions with them?? Do we have a case?
