Because my husband has been hiding money and cheating on income taxes (the forensic accountant's report just substantiated that claim) I have been receiving minimal temporary spousal support ($750/mo) for all of 2009. The taxes I owe are more then 1 month's support. I cannot afford to pay them.
We go to court next week. Can I ask the judge to have my husband pay my taxes this year with our community funds? I do not have access to them. He does.
Could he deduct it from my support?
Would I declare it as income?
Spousal support is my sole means of income after being a stay at home mom for 31 years.

You can ask.
The court will decide.
You should also know that you can not live on spousal support forever.
You will be required to prepare to support yourself.
Your remaining questions would be best answered by your attorney.

I know. I am 60 and have a 10th grade education....I am trying to get my GED now.
My husband is a professional with a doctorite. He owns his own business. It is a big change for me but I'm trying.
