I do custom software development for a customer. That customer takes the software that I write for them, and resells it to their customers. My customer is unable to pay their latest invoices, however they still continue to resell what I have written for them (including portions they haven't paid for). What can I legally do to recoupe my investment? I assume I can sue them for the unpaid invoices, but am I also able to restrict them from reselling the software with the included portions wich are unpaid?
 
If you want to see a penny of that money, hire a lawyer.

This is too complicated for you to do yourself.

Your client is probably going bankrupt.

How much do they owe you?

What is your client's home state?

Is Ohio your home state?

What actions have you taken so far to collect?

What has been their response?

Army Judge gives excellent suggestions. My only addition would be for you to send a breach of contract letter and to order them to cease and desist using your intellectual property. Include a demand for the money owed to you as well. A lawyer will be able to draft a superior letter which also might include some items that you have not considered. Best of luck to you.
