My jurisdiction is: New York/Hempstead

My Wife is threating to leave our house , take our son and Use her tax return to do so. Can she legally just take her tax return? We also have a Joint Account, and will use my taxes to pay Bills, etc.. What can I legally do to prevent this or can I sue her if she does?

You can't prevent her from leaving. And her tax return is her own to do with what she wants. Whether she can take your son, and how your assets are to be distributed, is either up to a court to decide or for the two of you to agree on.
 
You can ask for a hard copy check of the tax return instead of direct deposit. You both have to sign the return so if you have the check mailed to you in both names, she will have a tougher time leaving with the money. Of course she cannot file anything without your help so keep that in mind.
