Separated and ready to move on (child involved)

My soon to be Ex wife and I have been separated since November of 2008 and under the divorce law here in NC we must be separated for at least a year before we can get the Divorce.

We do however have a small child (20 month old daughter) and when it comes to her we have agreed on Joint custody which is broken down by 2 days on 2 days off and every other weekend.

I would love full custody and so would she so this is the only way we could meet in the middle.

Here is my question.

I have met a really great lady who also has kids from a previous marriage and she and I have hit off really well to the point that we are looking at getting married in the future. Her girls are great with my little one and I am good with them.

Now my question is simple.....If this lady and I were to move in with each other what kind of problems would it create? I understand that once separated i can move on just not get remarried. The thing that worries me is can she use this against me and gain full custody?

Not speaking ill of my soon to be ex but we are separated due to substance abuse and extramarital affairs.

What state are you in?

They're in NC.

While it may be okay to date while separated in NC, it certainly will look bad to cohabitate with someone else before you're even divorced. If I'm not mistaken, adultery is grounds for divorce in NC. Even though you're separated, you're not divorced, so that's adultery.

It is a terrible idea to do this when you are not divorced yet. What is the rush? Wait unitl you are divorced then move in.
