My children and I live in Texas, their father lives in California. He is retiring from the Marines this month and will be collecting retirement (which I get a percentage of, according to our divorce decree). He still has no job lined up, and has been getting into trouble a lot lately. He and his second wife are divorcing, it's ugly. She has had him arrested for stalking and so on. Up until now, he just got a slap on the wrist. He has continued to be an idiot and is in big trouble now and may quite possibly go to jail/prison. My question is: If he does get locked up, can his retirement be used (garnished) to pay his child support? While in the military, the child support was automatically taken out of his pay and sent to the OAG in Texas, who then forwarded it to me. I don't know what to expect now or how to proceed. Any information would be greatly appreciated.
