Recently Divorced. Trying to move out of state.

My divorce was final about 3 months ago. I have joint custody of two children and am the primary custodial parent. I am trying to move from Oklahoma to McKinney, Texas (approx 200 mis). I have given notice to my ex in writing of my intentions. I have now been served with a summons to appear for Modification in Custody arrangements. Can he prevent me from moving or taking my children? What are the possibilities here? What can I do to improve the possibilities of me being prevented from moving? What will help my case?

You have posted very limited information regarding the NCP's involvement with the children. How often does the NCP have the children? Is s/he paying court ordered support? How is it in the CHILDREN'S best interest to move?
 
200 miles is not very far away to move. But Bay is right you need to prove it is in the children's best interests.
 
Dad has the right to fight the move. Be prepared to prove the move is in the childrens best interest, and you also might be on the hook for all travel expenses for visits. You do not get to move the kids out of state just because you are moving.
