Reassessment of finanaces and court order alimony garnishment

What is the name of your state (only U.S. law)? California divorce.

I'm not sure if this would be a reassessment or just a first assessment because the first agreement was decided between our paralegals or just my paralegal so I would appreciate some kind of legal advice about my divorce case. Was legally married for 28 years. Separated for three (3) years six (6) months. Divorced for one (1) year. Went to paralegal for divorce . Divorce agreement was supposedly between both parties. Was under the impression the "agreement" was also supposed to be legal and binding. Disclosure of finances was not done and a set amount of alimony was agree upon between both parties paralegals. Was told by my paralegel that 40% is standard amount and that my ex-husband was being generous and paying approximately $100.00 up and above the due amount. Alimony amount was based on one (1) months pay stubs. Did work during marriage. Also worked with him in home businesses throughout the marriage. Worked while he went through school. Eventually had to quit working to take care of children. Became ill and could not return to work. When I filed for Social Security Dissability/Insurance after separation was approved but denied benifits because he had stocks I was unaware of so we had too much income for me to get health insurance through Social Security. Have many existing health problems which I have to be on daily medications for and cannot afford health insurance or to go to doctors because of the cost of doctor appointment fees. Was alloted 40% so I was told. According to paperwork alimony was to be paid via direct deposit. Have not received payment and ex-husband has discontinued direct deposit. Sort of in a bad financial predicament. Am unable to work. Alimony only form of income. A FL-343 form was never filled out and filed and the only agreement I have is on the FL-180. Had to move to North Carolina due to financial difficulties.

My ex-husband has not been paying alimony on a timely basis which has caused bigger financial difficulties because of late charges to my monthly bills. I had this posted to another site and had 93 views but no one was able to give me advice. I would truely appreciate any advice that anyone could give me.

Paralegals are not supposed to provide you with legal advice.

Paralegals work under the auspices of a licensed attorney.

I suggest you hire a licensed California attorney.

Your divorce might not be legal.

Even if it is legal, the paralegal faces potential legal liability for dispensing legal advice.

Your husband might have set you up in this matter.

He might KNOW that he doesn't have to pay you a dime, if there is NO divorce (or if the legality of the divorce is in question).

Courts will not enforce agreements made outside of court with the force and effect of law.

Only a judge can order someone to pay alimony, not a paralegal.

From what you have posted, you might have run into a papermill!

Speak to a lawyer about this ASAP!!!!

The fact that YOU are now in North Carolina leads me to conclude your husband scammed you!

You now need a lawyer in North Carolina ASAP.

But, you'll probably have to return to California to get your divorce.

You are in a difficult and tragic situation because they scammed you!
