My girlfriend is starting to file for divorce but we have some questions pertaining to it due to the other half. She owns her house that was bought before the marriage and did all upgrades to it before also. He's trying to convince her that he's owed part of the value. Does he have any rights to anything? They have 2 kids together that are fully in her custody.

I'm sure he has a valid claim to something, but not the house, if things are as you described them.

Your friend needs to engage an attorney to protect her assets, especially her home.

She might wish to cease communicating with her soon to be former spouse, too.

People divorce because they can no longer stomach the sight of the other.

Communicating with him, other than about their children, is never productive.

He's trying to convince her that he's owed part of the value. Does he have any rights to anything?

Yes.

He could have a right to half the equity that has built up in the years that they have been married.

By the same token, she could have a right to a slice of any 401(k) or retirement plan that he has contributed to during the marriage.

She should have a lawyer.

He was jobless the majority of the marriage so unfortunately no benefit to her lol but ya she was worried about the house since he wants to go after everything and a lawyer is deff on the way
