my 18 yr old daughter is pregnant by her 17 yr old boyfriend. we want to give the baby up for adoption. the parents of the 17 yr old boyfriend want to adopt the baby against our wishes, do we have any recourse against this?
 
None whatsoever. Your daughter is a legal adult. She, and only she, has the right to make that decision.

The child's father will have every right to establish paternity and may not want his child adopted out. If your daughter does not want the child and the father does, then what difference does it make?
 
My guess is that you are forcing your opinion on your daughter. What does SHE want? And more, if you are ok with an adoption, why do you not want them to adopt a baby they are related to?

The boy has every right to the child just as your daughter does. While you are obviously important in her life, you have no legal right to be pushing people around with regard to this baby. You are grandparents not parents. Your daughter has her rights, the boy has his rights, you have none. You should back out of this and let people do what is best for the baby instead of trying to fix your life. Does that make sense?

This is a baby, not a problem.
 
Just adding a note; I believe that paternity has to be established legally first in most states (though jharris can correct me if I am wrong. :) ) but after that, yes, the dad would also have a say in the matter.

You, however, do not. At all. Ever. Not under the law.
 
I agrew, what difference does it make if the fathers family adopts if she does not want the baby? She does not get to call the shots here. If she is doing this just to get back at the baby's father she needs to think again and she cannot go through with a fraudulent adoption, she needs to identify the father and he must terminate his rights. The father is free to ask for custody or for his parents to adopt.
 
Yes of course Cbg is right. He will have to establish paternity but that doesn't seem to be in dispute. So, he will have rights as soon as that is done.

And something for your daughter to consider. She committed a sexual assault by having sex with a minor. She should consult a Criminal Defense Attorney to see what the potential fallout will be for her.

The AOC in Calif is 18 and that state is VERY diligent in prosecuting for statutory rape.
