Pension Plan

My Dad passed away leaving my mom his pension and she got a notice in the mail today saying that they forgot to tax her checks so now she wont get a check for 2 months, can they just do this, I mean she just got the notice today and the check was suppose to be here tomorrow, now she has no way to even pay her rent, I just dont understand how its ok for them to do this leaving my mom in this kind of situation. Any information that anyone could give me would be great, Thanks

If I were running this paymenty operation (and I have paid pensioners in the past), I would have just started withholding going forward. However, there is no law I know of that would prevent the payer from taking the whole net from the next two payments for the back taxes. Someone else might.
