My husband had filed for a paternity test, but the judge denied the request with prejudice because the mother of the baby is married and he does not want to break up an intact family. Do we have any rights since the judge ruled with prejudice?

She is now saying that she may leave her husband and may agree to a paternity test if it is positive and her marriage stays in tact do we have the right to file for visitation?
 
How old is the child? it might be too late for your husband to challenge paternity if her husband is the legal father. Even if she seperates from her husbabnd, he is still the legal father and it doesn't sound like a paternity test can be done, at least through the courts anyways. If your husband wants to do one on his own and mom agrees, he can do that.

WE have no rights. only your husband does.
 
You need to appeal that ruling before it becomes final. I'm not sure of the time limits in your state. How long has your husband known about the child? He has rights to that child. He has a right to legitimate that child if it is biologically his and he is within the time limits. Check with a lawyer Quickly.
 
I just looked at the date stamp, you are out of time for an appeal. Check with a lawyer for options.
