Company pays out "overtime" with cash (and doesn't report it to the state) and only pays straight time for overtime (not time and a half).

The nonreporting of the wage and not withholding the applicable taxes is definitely illegal.

Regarding the overtime:

Are you a nonexempt employee (simplistically, paid hourly)?

What type of business is this (not its name, please)?
