I'm seeking infor. Can an employer cut an employees work hours for no reason and then turn around and hire other people for the job. This employee comes to work faithfully and does their job. This same employee has been told they are not allowed to work extra or get overtime while other employees are allowed to. Some other employees are allowed to come in repeatedly late, not wear safety gear, sleep on the job and just in general not work much at all, while employee number one is worked like a dog as well as treated like dirt. The employees are also made to run heavy equipment that is not safe, i.e., no doors, no brakes, tires coming off, no safety belts or cages, no lights etc. This is a mining company. And yes they know the best thing to do is leave which they are trying to do, but are there any legal actions they can take or supervisory boards they can go to? There are safety inspections done but they always know ahead of time and the company hides, disguises or shuts down items which may be questioned by inspectors. Thanks for any suggestions. :)

Treating you differently than other employees may be unfair but it's lawful as long as the reason you are being treated differently is not because of your age (if over 40), race, gender, national origin, religion, handicap, or some other protected status.

And yes they know the best thing to do is leave which they are trying to do, but are there any legal actions they can take or supervisory boards they can go to? Sure. Contact OSHA and report the violations, as well as any specific regulatory agency that oversees mining concerns.
