I filed for divorce from my wife 2 months ago, and while we are waiting for the finalization, my wife and I have been dealing with courts for custody of our 2 yr old son. At the time she was served, she called the police, and took the baby and left on her own up to her sisters house, which is about 1hr and 10 mins away up in the high desert. We have gone back to court since, and the judge awarded me temp custody on weekends for 3 straight months, and we were to meet at a designated half way point. Now 2 months later, her sister and family are getting tired of my wife and son, and are going to kick them out within 48 hrs. Now, keep in mind...my wife has a license, but no car. She voluntarily quit her job down here, and currently is not working. So, in theory, she will not be able to continue to take care of our son properly. So, I would like to know how I can go about getting custody of my son, until she gets back on her feet. Are there more forms to fill out? Can I call someone, or someplace that will help? I do not want either of them in a shelter, I certainly don't want anyone out in the streets. But going thru a divorce, I want custody of our son with his best interest at heart. I have been their provider since we were wed 4 years ago. I have been working at the local hospital for 3 years, I have a car, health coverage. Please help me with any information would be great.

You must do everything, regarding custody through the court that issued the original orders.
If you take your wife in, you potentially jeopardize your divorce.
Your wife has a say about custody, too.

Being poor, homeless, insane, a child molester, drug addict, a convicted murderer, or worse; doesn't preclude you from being a custodial parent.

You can't take custody from your wife just because she's fallen on hard times.

Your best bet is to consult with an attorney BEFORE doing anything.

Something you do out of kindness today can be used to thwart you in the future.
