Needing advise on my daughters rights: from Jersey moved to Virginia, met husband about a year ago, married in Dec while pregnant and living with his parents, who supported him and put a roof over her head, baby born in late June, parents did not care for her and husband does not work but attends school for about 3 hrs in morning...he has many issue's, she has minor ones but none compared to his, father is a CO in jail in same town, they all agreed and made her and baby leave approx 2 weeks ago (gave money and followed her for about a hour to make sure she left) assuming she could live with aunt, day after he freaked and wanted her back but for the next week he loved her then didn't..this is all documented through email, text and v/m to a few relatives including her (saved) came up later that week and left again 10 hrs later stating he can't handle what he did but stated he would come back after course within the next four months but then called DYFS who came out and cleared her but he continued to call DYFS who stated he was not speaking any sense and will write letter to court. canceled phone and tried car ins, per DYFS they told her she had to file for custody and she did the next day, emails continued but stating she kidnapped his daughter who in previous emails denied was his and was going to surrender rights, but now he has an appointment in Virginia to see who will take this to court for custody (both parents work full time), she has no money and no support and can never go back, she fears him and family because of the fathers status. my question is do you think he could win and if they award virginia as the home state will they make her move there with no where to go and will her court date in Oct supersede his court date for custody? I would appreciate any advise
 
Virginia will have jurisdiction. The child is there and they will rule first. It is unlikely that she will lose custody, she will likely get custody and a child support order. She should be ready to show any abuses or problems so the court is aware. She won't have to move back anywhere. He didn't have a custody order in force when she left and a judge isn't going to make her move close to him with no support.

She will be ok. Good luck.

hey Jharris before you get beig crest chested you need to know the other side, and evidence, before you go all out actin like your this big shot 'The law" lawyer" thats so tacky of you, i saw your britney spears threds do you have anything better to do with your time? Until you know the whole story, Stop makeing out like soemone will get custody and child support if you only knew the condition of both parties than youd have a right to talk..right?
 
Thanks for your concern. The law favors the Mother in custody cases. Many times regardless of merit. I used conditional language "unlikely" and "likely" to cover the idea that I don't know both sides of the story.

As for the big shot lawyer, I don't know about a big shot but I was a lawyer for several years until I moved out of Virginia. I still do ghost writing for attorneys as I have several years of actual litigation experience, appeal experience, federal civil and Habeas experience, and even two cases in the US Supreme Court. I finished a 30 page appeal brief this weekend, and I'm going to do two Arraignment waivers, two discovery requests, and a Motion for Declaratory Judgment tonight. Does that make me right all the time, of course not. I've learned a lot on this board already, and I really do enjoy it.

I hope I haven't offended you but I didn't ask for your attack either. I give my advice here and you give yours. That's what the board is all about isn't it?

No body attacked you. You just dont have the other persons evidennce opposed to her side, so you dont know what will happen and good advice would be to back up alittle on giving someone hope that their going to get custody and money when you dont know the whole entire story. thats all, if you think thats an attack, im sorry that your so soft.

get all the fact before you start telling people what will happen you dont even know what evidence the father has, so stop being cocky, like mr know it all its ugly law practice and very a tacky position.

no body cares what you have its what the father has in his corner for evidence that will determine the outcome. thats it. You sir are just a nosey individual, replying to every sinfgle custody case on the internet.

Thats an old school law that near applies any more because alot of mothers out their dont deserve to have children because their nothings.

Whats wrong with a good father standing up for his child? Nothing.
Thats the problem with america. Its allllll about the motgher, mother this and mother that....where is the father, in any of it?

Fathers pull just as much weight in it as the mother. period. so what she carried the baby for 9 months........Big whoop.
 
Why don't you admit that you are the ex- in question who is stalking his ex-girlfriend on this site?
 
Whether you like it or not, the law favors the Mother. It's not just an idea, its stated. The law especially favors the mother when the father is a stalker and a psycho like you seem to be. You are fortunate that I'm not her attorney because I would be headed to get a warrant for your arrest for stalking. If you are righteous, good luck, but your attitude here pretty much proves who you are.

Racist? Wow. I don't have a clue what race you are, nor do I care. But I'm sure you think its relevant. Poor girl has to deal with you for the rest of her life. Live and learn.

Father isn't a RACE. So I can't be racist. You however are the father in question so everyone knows that you are biased. You are also STALKING the mother of your child to try to discourage her from fighting you. You don't have to be done with me. You can't intimidate me like you can her. She is going to get free of you, and you are going to be the one paying the bill.

Go ahead, start complaining about whats going to happen. It will happen anyway.

I think the word you are looking for is "bias".:rolleyes:

Perhaps be taken more seriously if you utilized your spell-check option. Proper grammar and capitalization wouldn't hurt either.;)
 
Okay. Back to the OP.

Jurisdiction, unless Dad doesn't file within the 6 months it will take Mom to establish residency in NJ (per Family Code), will be in VA.
