oh please can anyone help me and my daughter

My daughter who is 11 lives with her dad most of the time and I get to see her every other weekend. Here lately she tells me that she needs me more and i can see it in her eyes. i need her too i have already missed so much and not by my choice. I do everything I can and tonight she called me begging me to come and get her. I couldnt and that kills me. I cant talk to her dad about this because he will not listen to me about what she needs or wants. I need to know how old a child needs to be to decide where to live, or I need to know how I can get more time with her.

Not sure what you are wanting but you are going to have to file for custody or for more parenting time in court. Dad doesn't have to allow visits outside of your time without a court order.

You don't have to file for custody to get more parenting time. You just have to request more parenting time which would mean there will need to be a modification of the current visitation plan.

How long has he had custody and why?

he has had custody for 7 years, and it was because i dont have the kind of money that he has and the judge said he and his wife were more financially stable. I am wanting and needing more time with her. she calls me everynight crying begging me to come and get her.
