No Bruises...No Abuse ???

I will try to make a long story short... my ex-husband and I have joint legal custody of our 12 year old son. We all live in the state of Nevada. I have contacted CPS 3 times previously regarding my ex-husband's abuse of my son. Once for shoving food down his throat and nearly choking him, another time for hitting him in the head with a shoe and breaking his glasses and a third time for throwing him up against the wall. None of the incidents resulted in any bruises, broken bones, etc. So, if you can believe it; CPS told me that unless my son has bruises, broken bones, etc. there is no evidence of abuse and they will not file a report. They have talked to my ex but have told both myself and my son that unless he is obviously physically harmed there is nothing they can do. My son just told me that his father recently through him up against a wall again and then picked him up and threw him towards his bed where he hit his head - but again, no bruises. My son says "Why should we tell anyone, they won't do anything and I'm tired of being called a liar." WHAT DO I DO??? SOMEBODY, PLEASE - ANY ADVICE WOULD BE GREATLY APPRECIATED. Thank you.
 
Have you reported the incident to the police?

The bottom line is that without proof, there is no case. Your son may not be a credible witness. Sorry to say it, but kids DO lie. Because they lie, their word rarely holds up against a parent's. And, yes, parents can lie, too. But before the state prosecutes someone or even removes a child from the home, they tend to want to see SOME proof of the abuse beyond the complaint of an estranged parent who did not witness the event(s) in question.

you can take this through the family court and ask for supervised visits and perhaps the judge will listen to the childs testimony. Is he scared of his father and is he willing to tell the courts that? since CPS wont do anything, time to take this to court.
