My husband and I are about to purchase a new home in full cash. He is on SS disability but owes back payments on child support. Is it wise to have the home in both our names or should it be in my name only?

If his name is on the home along with mine, can the State place a lien on our home? We live in Florida.

It's never wise to co-mingle ANYTHING when there is an outstanding child support debt.

Please pardon me for asking - but if you can afford to plump down cash and purchase a home outright, is there any reason why you couldn't simply pay off the arrears? Then it will never be an issue.

Social InSecurity might want to know how he came into the large amount of cash.

I suggest you spend some of that cash on an attorney.

You're about to embark on a very slippery slope.

In answer to your question, yes, a lien can be placed on your home.

But, the home can't be sold out from under you.

Now, Social InSecurity and MediScam might be very interested in that bag of loot you're gonna use to purchase that home. Be careful.

You live in a very debtor friendly state, and his disability will allow him to possibly stiff his children.

Spend some of your loot and discuss this with a lawyer.
