My wife and I have reached the breaking point of our marriage and I am ready to file for divorce. Our house is in a negative equity situation and we have no other assets of significance involved. We have no children together and have been married for 4 years.
The house title is in both of our names but, because of her bad credit, the mortgage is in my name only. Since there will be no equity in the house at the time of divorce, do I owe her anything to stay? Can I ask her to just leave and I'll assume the negative equity debt to keep the house?
