Hello. I need help. My son was born in Savannah, GA but his father lives in Madison, Wisconsin. He has not been an active roll in our childs life what so ever financially or physically and has had a court order on our court date which is the 24th of June stating I and our son need to be in Wisconsin. Seeing as how he has not helped out financially it is not feasable for me to take off work and be there for this court date which is for placement and child support. He has denied the child is his the whole time and has done nothing to help but give me the run around through the court system. Is there anyway I can get the case transferd to Georgia or get a continuence and if I can how do I go about doing that. I am scared to also go to Wisconsin in fear that they will not let me leave again with my son back to our home here in GA. What should I do?

Is there a current order for support?
 
If paternity has not been established and you did not file for CS, you are not entitled to it. If WI has jurisdiction then it is going to be VERY difficult for you to transfer it to GA if the father still lives in WI. If you want to move you need to prove it is in the childs best interest.

So we already have the paternity test done and it came back he is the father of the child. He is the one that pursued court and the child support agency in wisconsin. What I dont understand is that my son is a resident of Georgia and was born here...Was only conceived in Wisconsin. Does this mean that they have jurisdiction.

According to WI statutes, since the child was conceived there, WI can assert jurisdiction.

(6) The individual engaged in sexual intercourse in this state and the child may have been conceived by that act of intercourse.

You should consult an attorney to see if you can change venue to GA, and you should do it before responding to the petition.
 
Moen, I have reason to believe that the child's father has been trying to be a part of the child's life, and that you have prevented that. So, my additional legal advice to you is that this can go very wrong for you in a custody hearing. If you don't learn to co-parent, it is possible that you may lose custody of your son. Do the right thing. Your son has a father, and the father has a right to be in the child's life.

How old is the child?
